1. About these Terms

These Beta Terms of Use (“Terms”) apply when you access or use the beta version of the thrivvy platform, including the Thrivvy Wellbeing Index, beta product-matching features, personalised insights and related testing or feedback activities (together, the “Beta”).

The Beta is operated by Thrivvy Ltd, a company registered in England and Wales under company number 16203163, with its registered office at Unit 4 Webster Court Carina Park, Westbrook, Warrington, England, WA5 8WD (“thrivvy”, “we”, “us” or “our”).

By selecting “Continue to questionnaire”, you agree to these Terms.

Please read them before using the Beta. Our Privacy Policy explains how we collect and use your personal information. Any consent we request for the use of health and wellbeing information is obtained separately from your agreement to these Terms.

These Beta Terms of Use govern your participation in the thrivvy beta programme.

2. Important summary

The Beta is an early testing version of thrivvy. It is still being developed and may contain mistakes, incomplete information, unavailable features or technical problems.

The Beta:

  • is provided free of charge;

  • provides general wellness information and experimental product matches;

  • does not provide medical advice, diagnosis, treatment or emergency assistance;

  • should not replace advice from a doctor, pharmacist or other appropriately qualified professional;

  • must not be relied upon to make decisions about medication, treatment or a medical condition; and

  • may change significantly or be withdrawn during testing.

Please contact an appropriate healthcare professional if you have questions or concerns about your health. Seek urgent medical assistance through the appropriate local emergency service if you believe you are experiencing a medical emergency.

3. Eligibility

You may participate in the Beta only if:

  • you are at least 18 years old;

  • you are legally able to enter into an agreement with us;

  • the Beta is lawfully available to you in the country or territory from which you access it;

  • you provide accurate information during registration and testing; and

  • you comply with these Terms.

The Beta is intended for individual consumers. You must not use it on behalf of another person unless we have expressly agreed otherwise in writing.

We may ask you to confirm your age or eligibility. We may refuse or end access where we reasonably believe that an eligibility requirement has not been met.

We are currently developing and testing the Beta primarily for users in the United Kingdom. We do not actively recruit Beta participants outside the UK at this stage. If you access the Beta from another country, some features, products or information may not be appropriate or available in your location.

4. The Beta service

The purpose of the Beta is to test and improve the thrivvy platform before its wider release.

Depending on the testing phase, the Beta may allow you to:

  • complete the Thrivvy Wellbeing Index;

  • receive pillar scores or an overall wellbeing score;

  • view general wellness insights;

  • receive experimental product matches;

  • review test products or product records;

  • follow links to third-party websites;

  • test new features;

  • answer research or feedback questions; and

  • tell us about your experience.

The particular features available to you may depend on the testing group, device, location or stage of development.

The Beta is provided entirely free of charge. Users cannot purchase products directly through thrivvy during this Beta. Nothing in these Terms commits us to releasing a paid or public version of thrivvy.

Participation does not give you any ownership interest, membership rights, shares, financial entitlement or guaranteed future access to thrivvy.

5. Beta status and possible errors

You acknowledge that the Beta is unfinished and is being made available for evaluation and testing.

It may:

  • contain errors, inaccuracies or outdated information;

  • produce incomplete, unsuitable or unexpected results;

  • experience delays, interruptions or loss of functionality;

  • fail to work with particular browsers, devices or operating systems;

  • change without following the processes that would normally apply to a finished service; and

  • be unavailable for maintenance or technical reasons.

We will take reasonable care in providing the Beta, but we do not promise that it will always be available, uninterrupted or error-free.

Please report suspected errors to info@thrivvy.com. Where reasonably possible, avoid including unnecessary medical or other sensitive information in support messages.

6. General wellness information—not medical advice

thrivvy is designed to support general wellness awareness and product discovery.

The thrivvy Wellbeing Index, scores, insights, explanations and product matches are provided for general informational, educational and testing purposes. They are not intended to:

  • diagnose any disease, condition or disorder;

  • assess your risk of developing a medical condition;

  • monitor or treat a disease or medical condition;

  • recommend medical treatment;

  • determine whether a medicine or treatment is suitable for you;

  • replace the judgement of a qualified healthcare professional; or

  • provide emergency or crisis support.

A score or product match is not a clinical assessment and should not be interpreted as confirmation that you are healthy, unwell or experiencing a particular condition.

You should speak to an appropriately qualified healthcare professional before using a wellness product where relevant, particularly if you:

  • are pregnant or breastfeeding;

  • have a diagnosed or suspected medical condition;

  • take prescription or non-prescription medication;

  • have allergies or intolerances;

  • are preparing for or recovering from medical treatment;

  • experience persistent or concerning symptoms; or

  • are uncertain whether a product is appropriate for you.

Do not disregard professional medical advice or delay seeking it because of information provided through the Beta.

7. thrivvy Wellbeing Index

The thrivvy Wellbeing Index is based on the information that you choose to provide. Its outputs may be affected by:

  • the accuracy and completeness of your answers;

  • your interpretation of the questions;

  • changes in how you feel over time;

  • the limited information collected through the Beta;

  • the scoring methodology used during that testing phase; and

  • technical or data-processing errors.

The Index is not a comprehensive measure of your health and does not assess all factors that may be relevant to your wellbeing.

Scores and methodologies may be recalculated, changed or removed during the Beta as we evaluate the service. A score from one version may therefore not be directly comparable with a score generated by another version.

8. Experimental product matches

Product matches made available through the Beta are experimental recommendations generated for testing and evaluation.

They may be based on information such as your stated goals, preferences, questionnaire responses and the product information available in our database. They may not consider every factor relevant to your circumstances.

A match does not mean that:

  • the product is medically suitable or safe for you;

  • the product will achieve a particular result;

  • the product has been approved by a healthcare professional;

  • thrivvy has independently tested every aspect of the product;

  • the manufacturer’s statements are necessarily correct;

  • the product is free from allergens, interactions or side effects;

  • the product is legally available in your country; or

  • the product is better than every alternative.

Product formulations, warnings, availability, prices and manufacturer information may change. Always check the current product label, ingredient list, instructions, warnings and information supplied by the manufacturer or retailer before obtaining or using a product.

Do not use the Beta as the sole basis for starting, stopping or changing medication, supplements, treatment or management of a health condition.

9. Test products and third-party links

Some products shown in the Beta may be:

  • genuine products listed for testing;

  • draft or incomplete product records;

  • demonstration records;

  • products that are not currently available;

  • products supplied or suggested by third parties; or

  • included solely to test thrivvy’s matching functionality.

We will try to identify demonstration or incomplete information where reasonably practicable, but you should not assume that every product displayed is available for purchase or that every record is complete.

Product names, trade marks, images and descriptions may belong to their respective owners. Their inclusion does not necessarily mean that the manufacturer, retailer or other rights-holder endorses thrivvy or participates in the Beta.

The Beta may link to third-party websites where products or further information are available. Any purchase is made directly from the relevant third party, not from thrivvy. Third-party websites are controlled by their operators and may have their own terms, privacy practices, prices, delivery arrangements and returns policies.

We are not responsible for the availability or operation of third-party websites. Nothing in this section excludes any responsibility we may have under applicable law for statements we make or activities we directly control.

If a link is an affiliate link or we may receive a commercial benefit from it, we will provide an appropriate disclosure.

10. Your account and information

You are responsible for:

  • providing accurate registration information;

  • keeping your login details secure;

  • not allowing another person to use your account;

  • notifying us promptly if you believe your account has been accessed without permission; and

  • keeping your contact information reasonably up to date.

You must not create an account using another person’s details or misrepresent your identity.

Please do not share your password or secure access link. You are responsible for activity carried out through your account unless the activity resulted from something for which we are legally responsible.

11. Privacy and wellbeing information

Our Privacy Policy explains:

  • what personal information we collect;

  • why and how we use it;

  • the legal bases and conditions on which we rely;

  • who receives it;

  • how long we retain it;

  • whether it is transferred internationally; and

  • the rights available to you.

Questionnaire answers, wellbeing scores and related inferences may constitute health and wellbeing information requiring additional protection.

Where we rely on your explicit consent to process this information, we will request that consent separately. You may withdraw that consent by contacting info@thrivvy.com, as further explained in our Privacy Policy.

Withdrawing consent does not affect processing that was lawful before withdrawal. However, because this information is necessary to calculate the Index and provide personalised Beta results, withdrawal may mean that we can no longer provide some or all of the Beta to you. We will explain the practical effect when you request withdrawal.

Agreement to these Terms does not constitute consent to receive marketing. Marketing choices are managed separately.

12. Anonymised and aggregated insights

We may analyse Beta responses and feedback to understand trends and improve thrivvy. During the Beta, questionnaire responses, scores and feedback may be stored in pseudonymised form, for example, under a user number rather than your name. Pseudonymised information remains personal information where Thrivvy can reconnect it to you, and we will protect and handle it in accordance with our Privacy Policy and applicable data-protection law.

We may also publish or share genuinely anonymised and aggregated findings on the thrivvy website, in reports, presentations, media materials or public-relations activity. For example, we may report that a stated percentage of participants found a particular type of wellness product useful.

We will not identify you in these published findings. Before publication, we will take reasonable steps to ensure that the information does not identify you and cannot reasonably be combined with other available information to identify you.

Information that can still be linked back to you, including information held under a user number or other pseudonym, will continue to be treated as personal information and handled in accordance with our Privacy Policy.

We will obtain separate permission before using your name, image, identifiable quotation, testimonial or individual story for promotional purposes.

13. Security

We use reasonable technical and organisational measures intended to protect the Beta and the personal information processed through it.

However, no internet-based system can be guaranteed to be completely secure. You should take reasonable precautions to protect your device and login details and notify us promptly if you suspect unauthorised access.

14. Acceptable use

You must use the Beta lawfully and responsibly.

You must not:

  • use the Beta for an unlawful, fraudulent or harmful purpose;

  • attempt to gain unauthorised access to the Beta, another account, our systems or data;

  • introduce malware, malicious code or material intended to damage or disrupt the service;

  • interfere with the normal operation, security or performance of the Beta;

  • scrape, harvest, crawl or systematically extract data without our written permission;

  • use automated systems to interact with the Beta unless we have authorised them;

  • reverse engineer, decompile or attempt to discover source code or non-public algorithms, except to the limited extent that applicable law expressly allows this;

  • copy, reproduce or commercially exploit substantial parts of the Beta;

  • use the Beta to develop or train a competing product or service without our written permission;

  • test the Beta in a way intended to expose another person’s information;

  • upload content that infringes another person’s rights;

  • submit material that is abusive, discriminatory, threatening, defamatory, obscene or unlawful;

  • misrepresent Beta outputs as medical or professional advice;

  • publish confidential testing material where we have clearly identified it as confidential; or

  • help another person carry out any prohibited activity.

Nothing in this section prevents legitimate security research conducted with our prior written permission, reporting concerns to an appropriate authority, or exercising rights that cannot legally be restricted.

15. Feedback

We welcome feedback about the Beta, including comments, ratings, suggestions, ideas, bug reports and usability observations (“Feedback”).

You retain ownership of any original Feedback that you create. By submitting Feedback, you give us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free and transferable licence to use, reproduce, analyse, adapt, combine and otherwise use that Feedback to:

  • evaluate and improve thrivvy;

  • develop products, services and features;

  • train and support our teams; and

  • prepare internal research and analysis.

This licence does not give us ownership of your personal information or override your rights under data-protection law.

We may publish or promote Feedback only where it has been genuinely anonymised and aggregated, or where we have obtained any additional permission required. We will not attribute a testimonial or promotional quotation to you by name, image, account or other identifying detail without your separate permission.

Please submit only Feedback that you are entitled to share. You are not entitled to payment, compensation or ownership in thrivvy merely because we use an idea or suggestion contained in your Feedback.

16. Intellectual property

The Beta and its contents are owned by or licensed to Thrivvy Ltd and are protected by intellectual-property laws.

This includes, where applicable:

  • software and source code;

  • designs and user interfaces;

  • branding and trade marks;

  • text, graphics and illustrations;

  • databases and product-taxonomy structures;

  • matching and scoring methodologies;

  • reports and presentation formats; and

  • other material created for the Beta.

Subject to these Terms, we give you a limited, personal, revocable, non-exclusive and non-transferable right to access and use the Beta for your own non-commercial testing purposes.

No intellectual-property rights are transferred to you except for this limited right of use.

Your personal information remains subject to our Privacy Policy and applicable data-protection law.

17. Confidential beta features

We may occasionally give you access to a feature, document or testing group that we expressly identify as confidential.

Where we do so, you agree not to publish, disclose or share that specifically identified confidential material without our permission.

This does not prevent you from:

  • discussing your general experience of thrivvy;

  • reporting a concern to a regulator or law-enforcement body;

  • obtaining legal advice;

  • making a legally protected disclosure; or

  • exercising another right that cannot lawfully be restricted.

Unless we expressly identify material as confidential, you are not expected to assume that all aspects of the Beta are secret.

18. Changes to the Beta

We may change the Beta during the testing period, including its:

  • questions;

  • scoring methodology;

  • product data;

  • matching logic;

  • design;

  • features;

  • availability; and

  • eligibility criteria.

We may make changes without prior notice where reasonably necessary for security, maintenance, legal compliance, correcting errors or ordinary beta development.

Where a change materially affects your rights, the way the service is provided or how we use your information, we will provide appropriate notice and, where required, ask you to accept updated terms or provide fresh consent.

19. Changes to these Terms

We may update these Terms to reflect changes to the Beta, our practices or applicable law.

The effective date and version number at the top will show when the Terms were last updated.

Where an update is material, we will take reasonable steps to bring it to your attention. We may require you to accept the revised Terms before continuing to use the Beta.

Changes will not retrospectively remove rights you already have under applicable law.

20. Suspension and ending access

You may stop using the Beta at any time.

A self-service account-deletion function is not currently available. You may ask us to close your Beta account, withdraw relevant consent or exercise any applicable data-protection right by contacting info@thrivvy.com.

Closing an account does not necessarily require the immediate deletion of every related record. We will handle requests to erase personal information in accordance with applicable data-protection law and the circumstances explained in our Privacy Policy.

We may suspend, restrict or end your access where reasonably necessary, including where:

  • you materially or repeatedly breach these Terms;

  • we reasonably suspect fraud, misuse or a security risk;

  • continued access may harm another person, thrivvy or the Beta;

  • we are required to do so by law or a competent authority;

  • you are no longer eligible;

  • you withdraw a consent that is necessary to provide the relevant feature;

  • we discontinue the testing programme; or

  • technical or operational circumstances make continued access impracticable.

Where reasonably possible, we will tell you before ending or restricting access and explain the reason. We may act immediately where advance notice would create a security, legal or safety risk.

Ending access does not by itself determine how long personal information is retained. Retention and deletion are governed by our Privacy Policy and applicable law.

Sections intended by their nature to continue after access ends—including provisions on intellectual property, Feedback, liability and governing law—will continue to apply.

21. Our responsibility to you

Nothing in these Terms excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or breach of legal rights that cannot lawfully be excluded or restricted.

We are responsible for losses you suffer where they are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses to the extent the arise from:

  • information you provide that is inaccurate, incomplete or out of date;

  • use of the Beta contrary to these Terms, our instructions or clear product warnings;

  • reliance on the Beta as medical advice or as the sole basis for choosing, purchasing or using a product;

  • the actions, omissions, products, product information, content or services of third parties outside our reasonable control, including manufacturers, brands, retailers and third-party websites;

  • changes, interruptions, errors or incomplete results that are reasonably consistent with the Beta’s clearly disclosed testing status; or

  • losses that could reasonably have been avoided by following our warnings or taking reasonable precautions.

The Beta is provided for personal and non-commercial use. We are not responsible for business losses, including loss of profit, revenue, business opportunity, anticipated savings or business data.

Nothing in these Terms affects your statutory rights as a consumer.

22. Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, such as widespread internet failure, interruption of hosting infrastructure, cyberattack, natural disaster, industrial action, governmental action or failure of essential third-party systems.

Where such an event affects the Beta, we will take reasonable steps to reduce its impact and restore the service where practicable.

23. Complaints and contact

Please contact us first if you have a question, concern or complaint about the Beta.

You may have the right to complain to the UK Information Commissioner’s Office or the relevant data-protection authority in your country. Further information is available in our Privacy Policy.

24. Transfer of these Terms

We may transfer our rights and obligations under these Terms to another organisation—for example, as part of a corporate reorganisation, investment, merger or sale of the business.

We will ensure that any transfer does not reduce your rights under these Terms and will notify you where required.

You may not transfer your rights or obligations under these Terms to another person without our written agreement. This does not affect rights that are personal to you under applicable law.

25. No waiver

If either party delays enforcing a right under these Terms, that does not automatically prevent that right from being enforced later.

26. Severability

Each section of these Terms operates separately.

If a court or competent authority finds that part of a section is unlawful or unenforceable, the remaining provisions will continue to apply so far as legally possible.

27. Entire agreement

These Terms, together with any additional beta conditions expressly presented to you, form the agreement between you and thrivvy concerning your use of the Beta.

This section does not exclude responsibility for statements that cannot lawfully be excluded and does not limit any statutory consumer rights.

Our Privacy Policy and Cookie Policy explain our data and cookie practices but do not reduce the rights provided by these Terms or applicable law.

28. Governing law and international users

If you live in England or Wales, these Terms are governed by the law of England and Wales, and you may bring legal proceedings in the courts of England and Wales.

If you live in Scotland, you may bring legal proceedings in Scotland or England and Wales.

If you live in Northern Ireland, you may bring legal proceedings in Northern Ireland or England and Wales.

If you live outside the United Kingdom, these Terms are governed by the law of England and Wales. However, this choice of law does not deprive you of mandatory consumer protections provided by the law of the country in which you habitually live.

You may be entitled to bring proceedings in your local courts where applicable consumer law gives you that right.

You are responsible for checking whether accessing the Beta is lawful in your location. We do not represent that the Beta, its product information or products displayed through it are appropriate, regulated or available in every country.

29. Language

These Terms are written in English.

Where we provide a translated version, the translation is intended to help users understand the Terms. Nothing in this section overrides mandatory rights under local law, including any right to receive consumer information in a particular language.
